1. Booking and payment
A booking is confirmed when we confirm it in writing. Rates, the rental period, overtime, travel and any deposit are set out in the quote. Payment is due immediately: in full when the booking is confirmed, or on receipt of our invoice. Equipment isn't released and services don't start until payment has been processed. Unpaid amounts may incur a late fee where the law allows. Rental and service fees are non-refundable except as stated in the cancellation section.
2. Your responsibility for equipment
Equipment is your responsibility from when it's delivered to you or picked up, until it's returned to us. Use it with care, only for its intended purpose, by qualified people, and keep it protected from weather, theft and damage.
3. Loss and damage
You're responsible for loss, theft and damage (other than normal wear) while equipment is in your care, up to the cost of repair or replacement at current prices. Report any problem to us immediately. We may require proof of insurance covering rented equipment before a booking.
4. Late return
Equipment returned late is charged at the daily rate for each extra day or part of a day, until it's returned.
5. Cancellation
If you cancel within 48 hours of the start of a booking, you may be charged up to one day's rate, or as stated in the quote. Weather and other cancellation terms can be agreed in the quote.
6. On-set services
When we provide an operator, we'll perform the work with reasonable skill and care, follow the production's safety and confidentiality rules, and work hours as agreed in the quote. Overtime is billed as stated in the quote.
7. No guarantee of footage
Video assist is a monitoring and playback service. It is not the production's record of what was shot. We don't guarantee that every take will be recorded, saved or playable. The production is responsible for its camera recording and backups.
8. Our liability
To the fullest extent the law allows, Abby Video LLC's total liability arising from a booking is limited to the fees paid for that booking. We aren't liable for lost footage, reshoots, delays, lost profits or indirect or consequential damages. Nothing here limits liability that the law doesn't allow us to limit, such as for gross negligence or wilful misconduct.
9. Confidentiality
We keep your production's content confidential. See On-Set Content & Confidentiality.
10. Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be brought only in the state courts located in Gloucester County, New Jersey, or the United States District Court for the District of New Jersey, and you and Abby Video LLC agree to the personal jurisdiction of those courts. Nothing here limits any right you have under the consumer protection laws of the place you live that cannot be waived by contract.
