1. What Abby Monitor is
Abby Monitor is a free companion app for iPad and iPhone. It shows the live picture from a Mac running the abby. on a set, after that Mac's operator approves your device. Operators can make a device a Viewer or an Admin. Admins may also use group chats, take requests and talk-back.
2. Your license
Abby Video LLC grants you a free, non-exclusive, non-transferable license to use Abby Monitor on Apple devices you own or control, as allowed by the App Store Usage Rules. The app is licensed, not sold.
3. Apple's terms
If you got Abby Monitor from the App Store, Apple's standard Licensed Application End User License Agreement also applies. In addition:
- These terms are between you and Abby Video LLC, not Apple. Abby Video LLC, not Apple, is responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the extent the law allows, Apple has no other warranty obligation for the app.
- Abby Video LLC, not Apple, is responsible for any claims about the app, including product liability, failure to meet legal or regulatory requirements, and consumer protection claims.
- If anyone claims the app infringes their intellectual property, Abby Video LLC, not Apple, is responsible for investigating, defending, settling and discharging the claim.
- You confirm you're not in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and you're not on any U.S. government list of prohibited or restricted parties.
- Questions or complaints go to Abby Video LLC at [email protected].
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
4. Approval and access
Only the set's operator can approve your device, set your level, or remove you, and they can do so at any time. A production may choose to blank the picture while your device is screen recording, and may show your name faintly on your picture.
5. Audio, talk-back and consent
Admins can use TALK to send their voice to the set, and Abby Monitor plays live set sound. Use the microphone only while you mean to speak, and only where everyone in earshot knows audio may be live.
You are responsible for consent. The operator and the production must make sure everyone who is filmed, photographed or recorded, and everyone whose voice is picked up, has given whatever consent or release the law, the production and any union or guild rules require.
Some places, including California, Pennsylvania, Florida, Washington, Maryland, Massachusetts, Illinois and others, require everyone's consent before a conversation is recorded or listened to. That can include set audio, a talk-back microphone and audio fed to client devices. Tell people when audio is live, and don't record or send private conversations.
Set rules, union and guild agreements, location releases, and rules on filming minors or in private places stay the responsibility of the operator and the production. Abby Video LLC doesn't check or enforce them.
6. Messages, notes and group chats
- You're responsible for what you send: messages, notes, reactions, take requests and talk-back.
- Not for emergencies. Messages can be delayed or not arrive. Don't use them for safety, medical or emergency communication. Use the set's radio or call emergency services.
- Messages and group chats delete themselves after 24 hours, on the set's Mac and on every device. Deletion can't stop someone taking a screenshot, photographing a screen or copying a message before it's gone.
- Group chats are encrypted on each device. Abby Video LLC can't read them, so we can't recover, moderate, review or hand over their contents.
- To report abuse, tell the set's video assist operator, who can remove a device at once. You can also email [email protected], but we can't see the messages.
7. TestFlight and pre-release versions
We may offer beta, pre-release, preview or TestFlight versions. They may be unfinished, change without notice, contain more bugs, lose data or stop working, and we may end them at any time. Don't rely on a pre-release version for a paid job. Pre-release versions are covered by these terms, are provided strictly "as is", and are confidential until we release them publicly.
8. Using it properly
Use Abby Monitor only as the production allows. Don't record, photograph, share or publish what you see unless the production permits it, and follow the Acceptable Use Policy for chats, notes and talk-back.
9. Content on set
Pictures, sound, chats and notes belong to the production and the people who sent them. They travel between your device and the set's Mac, not to us. See On-Set Content & Confidentiality and the Privacy Policy.
10. As is, and limits
Abby Monitor is provided free and "as is", without warranties. We don't guarantee the picture, sound, messages or requests will always arrive. To the fullest extent the law allows, Abby Video LLC's total liability relating to the app is limited to $50.
11. Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be brought only in the state courts located in Gloucester County, New Jersey, or the United States District Court for the District of New Jersey, and you and Abby Video LLC agree to the personal jurisdiction of those courts. Nothing here limits any right you have under the consumer protection laws of the place you live that cannot be waived by contract.
These terms work together with our Terms of Service.
